1. INTRODUCTION
This Terms Of Service - Radio Hosting ("RadioHosting TOS")
supplements the General Terms and Conditions
between you on the one hand and
Server4All.Org (“Server4All.Org”)
2. RESOURCE USE
CPU & Memory - All accounts are monitored for their use of server
resources. If any account is using a high
amount of server resources we will contact
the customer to discuss the issue with them.
In serious cases where an account is using a
considerably large amount of system
resources (memory, CPU etc.) the account may
be suspended or script disabled without
notice to maintain the smooth running of the
server.
Data transfer, slots and autodj space allocations - Customers can request a
package upgrade or temporary resource
increase at the costs available to view on
our website at http://www.Server4All.Org. It
is the sole responsibility of the customer
to contact us in advance of requiring extra
resources to prevent account suspension. In
some cases, accounts are automatically
suspended when their resource limits have
been reached and manual unsuspension is
required by us
3. NETWORK AND AVAILABILITY
Network is defined as the equipment, software, and facilities
within the Server4All.Org network segment,
including Server4All.Orgs contracted ISP or
data centers services to which the
Server4All.Org network segment is connected
and collectively utilized by Server4All.Org
to provide dedicated and co-location
services
Service Availability is the total time in a calendar month that the
Server4All.Org is available through the
Internet, provided that Client has
established connectivity. Server4All.Org
takes responsibility for the Service
Availability within its immediate network
segment, and cannot be held liable for
problems directly related to an upstream
bandwidth provider.
The Server4All.Org Radio Hosting
Services will be available to clients free
of Network Outages for 95% of the time
Service Downtime is any unplanned interruption in Service
Availability during which the Client is
unable to access the services as described
in preceding section, provided the
interruption is determined to have been
caused by a problem in the immediate
Server4All.Org network segment as confirmed
by Server4All.Org. Service Downtime is
measured as the total length of time of the
unplanned interruption in Service
Availability during a calendar month.
Server4All.Org is not responsible for any
unplanned outages due to third-party
software failure are the direct
responsibility of the software publisher and
not of Server4All.Org
Scheduled Service Downtime is any Server4All.Org interruption of
Radio Hosting Services. Scheduled Service
Downtime occurs during a Server4All.Org
server maintenance window, which occurs in
conjunction with a 24 hour notice to the
Client via electronic communication.
We not cover or support Service Downtime caused by problems in the
following:
- client's local area network
- client-provided Internet connectivity or
end-user software
- entities inside Client's internal network
including, but not limited to, firewall
configuration and bandwidth shaping, local
area workstations, or other servers,
equipment, and software that have a
potential bearing on the local networking
environment
Service Downtime Exclusions - The following are excluded from the
monthly calculation of Service Availability:
- any utilized Scheduled Service Downtime
- any problems beyond the immediate
Server4All.Org network segment
- any interruptions, delays or failures
caused by Client or Client's employees,
agents, or subcontractors, such as, but not
limited to, the following:
- inaccurate configuration
- non-compliant use of any software installed on the server
- client initiated server over-utilization
- any problems related to attacks on the machine such as hacking,
bandwidth-based attacks of any nature, and
service or operating system exploits
If attacks like DDoS or flood the firewall will stop the attack but
if the attack can not be filtered, server
will automatically restart and the router
will stop the server port. The server will
enter in downtime for more than 30 minutes
up to attack is stoped! If the target IP
needs to be isolated and/or blocked, it will
be disabled! Therefore we recommend you use
an IP mask (like no-ip.com) for your radio
stream, because in this case server IP
address will be changed.
5. LIMITATION OF LIABILITY
We are not responsible for any claimed damages, which may result
from our servers going offline, or being
unavailable for any reason. This includes
damages which may result from the corruption
or deletion of data. The customer agrees to
indemnify and hold us and our employees
harmless from any claims, damages, including
but not limited to consequential damages
resulting from the use of the service which
damages the customer or any other party.
